These Terms & Conditions govern your use of jwtraintowin.com and your interactions with JW Training & Development (“JW,” “we,” “us,” or “our”).
By using this website, you agree to these Terms. Additional terms may apply when you purchase a membership, register for a program, attend an event, purchase merchandise or participate in training.
Website Use
You may use this website for lawful personal purposes, including learning about JW programs, booking services, registering for events and contacting JW.
You may not:
- interfere with the operation or security of the website;
- attempt unauthorized access to the website or its systems;
- use automated systems to misuse or overload the website;
- submit false, misleading or unlawful information; or
- copy, reproduce or commercially exploit website content without permission.
Training and Fitness Services
JW provides fitness, performance, personal training, H.E.R.O., HYROX, wellness and related services.
Participation in physical training involves inherent risks, including the possibility of physical injury.
Participants are responsible for considering their own health and ability before taking part in physical activity and for advising JW staff of relevant injuries, medical conditions or limitations.
Where required, participation may be subject to a separate:
- informed consent;
- assumption-of-risk or waiver document;
- health/readiness questionnaire;
- membership agreement;
- program agreement; or
- parent or guardian authorization.
These website Terms are not a substitute for JW’s participation waiver or membership agreement.
Not Medical Advice
Information provided by JW through this website or general fitness programming is for informational and training purposes and should not be considered medical diagnosis, medical treatment or individualized medical advice.
Consult an appropriate regulated health professional regarding medical concerns or whether an exercise program is appropriate for you.
Bookings and Appointments
Bookings may be made through JW or approved third-party scheduling systems such as Mindbody.
Availability, instructors, schedules and programs may change.
Clients are responsible for reviewing the cancellation, rescheduling, late-arrival and no-show rules applicable to the service they purchase.
Any service-specific cancellation policy presented during registration or booking forms part of the applicable transaction.
Memberships and Consumer Rights
Certain JW memberships or prepaid training services may qualify as personal development services under Ontario consumer-protection legislation.
Nothing in these Terms is intended to limit or waive rights that cannot legally be waived.
Where applicable, statutory cancellation and cooling-off rights continue to apply, including rights available under Ontario consumer-protection legislation.
Membership-specific prices, payment schedules, start and end dates, cancellation provisions and renewal terms should be set out in the applicable membership or service agreement.
Payments
Prices are displayed in Canadian dollars unless otherwise stated.
Applicable taxes may be added.
Payments may be processed by third-party payment providers. JW does not necessarily receive or store complete payment-card information when transactions are handled directly by a payment processor.
Additional purchase terms presented at checkout will form part of the transaction.
Refunds and Cancellations
Refund eligibility depends on the service, program, product, event or membership purchased and applicable consumer-protection law.
Where JW’s cancellation or refund policy conflicts with a non-waivable statutory right, the statutory right will apply.
Events
JW may organize open houses, dinners, seminars, competitions, workshops and other special events.
Event registration may be subject to:
- capacity limits;
- eligibility requirements;
- event-specific rules;
- cancellation deadlines; and
- additional terms communicated during registration.
JW may modify or cancel an event where reasonably necessary.
Merchandise
Descriptions, images, sizing and availability of JW merchandise are provided as accurately as reasonably possible.
Actual appearance may vary slightly due to photography, displays or manufacturing variations.
Product availability is not guaranteed until an order is accepted.
Intellectual Property
Unless otherwise stated, website content including text, logos, branding, photographs, graphics, layouts and other materials belongs to JW Training & Development or is used with permission.
Content may not be copied, reproduced, modified, distributed or commercially used without authorization, except as permitted by law.
Photos, Video and Testimonials
Participation in JW programs or events does not by itself grant JW unlimited permission to use a participant’s likeness or testimonial for marketing.
Where consent is required, JW may obtain a separate photo, video, testimonial or media release.
Third-Party Services
The website may link to or integrate services provided by third parties, including scheduling, payment, social-media and other platforms.
JW is not responsible for the availability, content, privacy practices or independent actions of third-party services.
Use of those services may also be governed by their own terms and policies.
Website Availability and Accuracy
JW makes reasonable efforts to keep website information accurate and current, but does not guarantee that every page will always be complete, error-free or continuously available.
Programs, instructors, pricing, schedules and other information may change.
Limitation of Liability
To the extent permitted by applicable law, JW will not be responsible for indirect, incidental or consequential losses arising solely from the use or inability to use this website.
Nothing in these Terms excludes or limits liability or consumer rights where doing so would be prohibited by law.
Liability relating to participation in physical programs may also be governed by a separately executed agreement or waiver.
Privacy
Use of personal information is governed by JW’s Privacy Policy.
Changes to These Terms
We may update these Terms periodically.
The current version will be posted on this page with the latest revision date.
Continued use of the website after changes are posted constitutes acceptance of the revised website Terms, subject to applicable law.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Nothing in this section deprives a consumer of rights or remedies that cannot legally be excluded.
